When the customer questioned an $80 deduction, the bank initially could not identify the merchant but later confirmed the charge was an annual fee.1 A card reissued in 2025 was marked "undeliverable, return to sender" and subsequently destroyed.1 The bank's explanation of the card's status shifted between communications: on August 13, it stated the card had expired in 2013 and was never reissued, but on August 28, it claimed cards were reissued every three years.1
CBA ultimately agreed to refund $1,040 as a "gesture of goodwill" rather than compensation, arguing that fee collection was lawful under the facility's terms and conditions and that the customer could have requested card cancellation at any time.1 The bank maintained that according to its regulatory code, the fee charges were justified.1
Investigation revealed the customer had conducted no transactions for seven years, though another cardholder on the account made a transaction in May 2024.1
