Australia's federal government is preparing to introduce amendments to online safety legislation designed to strengthen the enforcement of social media age restrictions for minors under 16.1 The move comes as recent research reveals a significant compliance gap following the implementation of the age restriction law in December of last year.1
More than 85 percent of young people under 16 continued using restricted social media platforms within three months of the law taking effect, demonstrating substantial enforcement failures.1 Research shows that approximately 15 to 19 percent of participants used fake accounts to circumvent restrictions, while 6 to 11 percent employed private browsing tools.1 Additionally, roughly two-thirds of minors under 16 reported encountering age verification mechanisms, suggesting inconsistent implementation across platforms.1
To address these compliance issues, the proposed amendments will significantly increase financial penalties for platforms, raising the maximum fine to A$99 million.1 The legislation will also grant the regulatory authority expanded investigative powers, enabling the online safety regulator to compel third-party service providers to furnish documents and information relevant to compliance investigations.1
