Residents of a luxury apartment tower at Elizabeth Quay in Perth have filed a lawsuit against developer Perth FEC Limited, a subsidiary of Far East Consortium, seeking compensation exceeding AUD $10.3 million for alleged construction defects.1 The 275 unit owners, acting through their owners corporation, have identified multiple building faults including waterproofing failures, fire safety issues, flooring problems, tiling defects, concrete damage, structural concerns, plumbing faults, elevator malfunctions, and electrical system problems.1
The dispute centers on funds obtained from contractor Probuild, which entered into administration in February 2022.1 Perth FEC received AUD $10.3 million from Probuild as a secured creditor, yet has refused to make these remediation funds available to the residents, according to court filings submitted Monday to the Western Australian Supreme Court.1 The owners corporation has already spent at least AUD $1.2 million of its own resources to conduct repair works on the building located at 11 Barrack Square, The Towers.1
