A three-judge panel from the U.S. Court of Appeals for the District of Columbia ruled Tuesday that a federal district judge did not have the power to overturn the military court conviction of former Army soldier Bowe Bergdahl, who was court-martialed for desertion in Afghanistan.1 The court determined that only a military tribunal possesses the authority to reverse its own convictions, rejecting Bergdahl's 2021 lawsuit in which he claimed the 2023 ruling violated his Fifth Amendment due process rights.1
