Iraq's Supreme Judicial Council has announced it is proceeding into the judicial phase of prosecutions against former Islamic State participants, placing 13 Australian men detained in Baghdad's Al-Karkh Central Prison at risk of capital punishment.1 The men, who survived after ISIS's defeat in 2019, were transferred from Syrian prisons to Iraqi custody earlier this year.1
The 13 Australians comprise six from Sydney, four from Melbourne, and one each from Perth and Adelaide.1 Among them is Yusuf Zahab, who was taken to Syria by his parents at age 12 and is now 22 years old.1 Under Iraq's Counter-Terrorism Law No. 13, those convicted of terrorism—defined to include perpetrators, accomplices, and those who incite, plan, finance, or assist such acts—face potential death sentences.1
The judicial phase announcement follows the completion of the investigative stage by the Supreme Judicial Council, which also resulted in the release of other detainees.1 One American, one Finnish man, seven Iraqis, and 457 Syrians were freed due to insufficient evidence.1 Six of the Australian defendants face additional allegations relating to the enslavement of Yazidi women.1 Australia's Foreign Minister has stated that the government will not provide repatriation assistance for these men.1
